General event conditions

1. DEFINITIONS

These General Event Terms and Conditions apply to all companies of the Lobster Group - Lobster for short -, namely Lobster Experience GmbH & Co. KG | Lobster Event GmbH | Lobster Communications GmbH | Little Lobster GmbH | loop luxury fair GmbH | Luxury Travel Business Club; means € = Euro; means force majeure in relation to a party, all circumstances beyond the reasonable control of that party, including, but not limited to, force majeure, epidemics, pandemics, swine flu, mourning, fire, explosion, earthquake, flood, volcanic eruption, ash cloud, storm, lightning, strike or lockout, Riots, war or political acts, terrorist, biochemical attacks, cyber attacks, national grief or other similar incidents, material shortages, terrorist or military activities, labor disputes and strikes, airline disruptions, public order disruptions, unavoidable accidents, interventions or regulations; are the terms of these General Event Terms and Conditions

2. SCOPE OF APPLICATION

These General Event Terms and Conditions of the Lobster Group, Starkenburgring 12, 63069 Offenbach, Germany (hereinafter referred to as "Lobster") apply to all services provided by Lobster to participants at conferences, training sessions, workshops, event series and comparable event formats (hereinafter referred to as "Events").

3. REGISTRATION AND CONCLUSION OF CONTRACT

Offers by Lobster for participation in events are subject to change and non-binding.

Registrations for events as participants can only be made bindingly via Internet, in writing, by fax or by e-mail.

Acceptance of the participant's registration by Lobster is only binding if written confirmation of registration (confirmation of registration) by Lobster has been received. The confirmation can also be sent by fax or e-mail.

Lobster decides on the acceptance of registrations from participants. There is no right to participation.

4. RESCISSION

4.1 The participant may withdraw from the event in full. Provided that Lobster receives written notice at least 48 hours before the start of an event (Lobster Dinner, Lobster Breakfast, loop POOL, loop CEE ROadshow) and 6 weeks before the start of a loop fair (loop MICE; loop leisure, loop CEE, loop Media, loop INBOUND) . If such a cancellation is received by Lobster less than 48 hours prior to the start of the event, a cancellation fee of €50 will be charged.For the loops fairs a cancellation fee of € 250 per meeting day will be charged. Should Lobster have paid any flight costs, those costs will be invoiced additionally. 

4.2 Neither Lobster nor its representatives shall be obliged to assist the Exhibitor with any documents required for entry into the country in which an Event will take place. Any error on the part of the participant not to receive such documents from the competent authorities will not be considered as a breach of contract. The participant may, however, send another person to the event who acts as a representative and requires confirmation from Lobster.

5. DISCLAIMER OF LIABILITY

5.1 Liability for death and personal injury is not excluded. Lobster is liable for intent, gross negligence and slight negligence. Neither Lobster nor its employees or representatives are liable for damage to property or financial losses based on simple negligence. The liability for intent and gross negligence remains.

5.2 Neither Lobster nor the operator of the venue or their representatives and employees shall be liable for any loss, damage or delay incurred by the exhibitor, subject to and taking into account Clause 5.1: a) as a result of force majeure; b) in relation to the movement of the freight from and to the venue; or (c) any other than personal injury or death by fire, theft or injury of any kind.

5.3 If the event is cancelled, postponed, cancelled or restricted, or if the venue is not available in whole or in part for the operation of the trade fair; a) an act of God; or b) Conflicts or misinterpretations, by national or regional authorities of the host country, its sponsors, representatives or other entities regarding any aspect of the fair, then: c) neither Lobster nor its representatives shall be liable for any loss, damage or delay resulting from such circumstances; d) Lobster is entitled, but not obliged, to hold the exhibition at another time and/or to move it to another location.

6. DAMAGES

The Participant will pay Lobster damages in the event of loss, damage, cost, expense or other claim: a) breach by the Participant of these Terms of Use; and b) acts or omissions of the Participant, whether negligent or otherwise.

7. CONSENT TO THE CREATION AND USE OF PHOTOGRAPHIC/FILM MATERIAL

By participating in one of our events, you agree that during the event, photographs and film material on which you are pictured may be displayed

8. DATA PROTECTION AND INTERNET TECHNOLOGY

a) Personal data, such as name, address, bank details and e-mail address, are stored when registering for an event.

b) All data shall be treated in accordance with the statutory data protection provisions. The collection and processing of personal data includes the storage, modification, transmission, blocking, deletion and use of the participant's data in compliance with the applicable data protection regulations and telecommunications secrecy. The data will be processed and used electronically and will only be stored for as long as is necessary within the framework of these regulations and in compliance with applicable law. Personal data will only be disclosed to third parties if the express consent of the participant has been obtained or if Lobster is obliged to disclose this data, e.g. due to a court order or official order or an event is held in cooperation with other companies. Lobster is entitled to process and use personal data as far as this is necessary for advertising and market research for its own purposes and for the demand-oriented design of the service. With his/her declaration of consent to the use of data, the participant agrees that his/her data may be used by Lobster for marketing purposes and that he/she receives interesting information from Lobster.

c) The participant has the right at any time to revoke his/her consent to the use of his/her data with effect for the future by letter post, fax or e-mail (to info@lobster-event.com).)

d) Lobster uses the state of the art SSL (Secure Socket Layer) technology to encrypt the data you transmit. This ensures that the data entered is encrypted and transmitted unchanged to the server. In the case of electronic data transmissions, however, data protection cannot be fully guaranteed according to the current state of the art. The participant is aware that the Internet provider is not responsible for the content stored on the web server and, under certain circumstances, for any other content that may be transmitted. can view the participant's data stored there from a technical point of view. Other participants on the Internet may also be technically able to interfere with network security without authorization and control message traffic.

e) We will pass on your contact details to the other fair participants as part of the event. You will also receive the contact details of other participants at this fair.

9. GENERAL

8.1 If any provision of these GPCs is held by a court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining provisions of these GPCs and the remainder of the provision in question shall not be affected thereby.

8.2 This Agreement shall be governed by German law. All disputes between the parties under this Agreement shall be submitted to the competent German courts, in particular the district court of Offenbach am Main.
